Warranty Terms & Conditions

Hitachi Products

Hitachi Power Tools Australia Pty Ltd (‘Hitachi’) warrants that all products supplied by it and purchased by you from Authorised Hitachi Dealers throughout Australia are free of defects except for those products listed under Warranty Exclusions.

Warranty Claims

If you consider that any product supplied by Hitachi is defective, you can lodge a claim under this Warranty and any apparent fault will be rectified free of charge by Hitachi or a Hitachi Authorised Service Dealer within Warranty Period, which is effective from the date of purchase provided that you meet the following conditions:

  • You must produce the original invoice or other proof of purchase document disclosing the purchase date.
  • All costs of installation, cartage, freight, travelling expenses, hiring tools and insurance are paid by the customer.
  • The product, being precision equipment, has not been misused, adjusted or serviced by any person other than a Hitachi Authorised Service Dealer.
  • The equipment has been installed correctly and is used in accordance with the Hitachi instructions supplied with the product

Hitachi offers this warranty to you in addition to all other rights and remedies that you may have under law in relation to the products to which this warranty relates.

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and for compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

Notwithstanding the preceding clause, Hitachi’s liability in respect of a breach of a consumer guarantee or any warranty made under these Conditions of Warranty for any products not of a kind ordinarily acquired for personal, domestic or household use is limited, to the extent permissible by law and at the option of Hitachi to:

  1. Replacing the products or the supply of equivalent products;
  2. The repair of the products;
  3. The payment of the cost of replacing the products or of acquiring equivalent products;
    or
  4. The payment of the cost of having the products repaired.

To the extent permitted by law, all other warranties whether implied or otherwise, not set out in these Conditions of Warranty are excluded and Hitachi is not liable in contract, tort (including, without limitation, negligence or breach of statutory duty) or otherwise to compensate the Customer for:

  1. Any increased costs or expenses;
  2. Any loss of profit, revenue, business, contracts or anticipated savings;
  3. Any loss or expense resulting from a claim by a third party; or
  4. Any special, indirect or consequential loss or damage of any nature whatsoever.

These conditions may only be varied with the written approval of the directors of Hitachi.

Warranty Period

1 year (including commercial use): For Tools, Batteries & Chargers.

Warranty Exclusions

This section identifies what is excluded under this Warranty.

This Warranty does not cover damage caused by:

  • Misuse or abusive use of the Hitachi product,
  • Incorrect operation or failure to operate the product in accordance with the Hitachi instructions supplied with the product,
  • Failure to clean or improper cleaning of the product,
  • Failure to maintain equipment such as regular services, lubrication, etc.
  • Operation of products with incorrect fuel to oil ratio,
  • Incorrect voltage or non-authorised electrical connections,
  • Improper installation,
  • Use of non authorised/non-standard parts,
  • Abnormal product performance caused by any ancillary equipment interference or other external factors,
  • Failure or any breakage caused by overload, dropping or abusive treatment, or use by the customer of non-genuine Hitachi parts,
  • Repair or other work carried out on the product other than by an Authorised Hitachi Service Dealer.

This warranty does not apply to power tool attachments, accessories, blades and cutters.

This Warranty does not cover products purchased:

  • From a non- Authorised Hitachi Dealer (such as purchases from unauthorised retailers and purchases over the internet, from local/international sellers or sites such as Ebay and Amazon,
  • At an auction, or
  • From a private seller.

If the product you are using has been rented or leased by you, and you consider a claim might be made under this Warranty, you should refer the matter to the rental or leasing company immediately and they will handle the matter.

This Warranty does not cover service costs in replacing and maintaining consumable parts and accessories that have ceased working through normal wear and tear such as, but not limited to: drill heads, blades, cutters and other parts classifiable as a consumable part or accessory.
